9:00 a.m. – 10:00 a.m.     What you didn't learn when studying for the MPRE: Louisiana specific ethics rules and recent updates (Ethics)

To become licensed to practice law in Louisiana, one needs to pass the Louisiana bar exam and the MPRE.  The MPRE is not state-specific, and tests one’s knowledge of the ABA model rules of professional responsibility.  There are many Louisiana ethics rules which differ from the ABA model rules.  This presentation will highlight most of those differences and some recent changes that may not be widely known by Louisiana lawyers, including trust account reconciliation rules and other “gotchas”.  There will be at least one lawyer joke which will allow discussion of multiple ethical rules.

11:20 p.m. – 12:20 p.m. 5 Essential Tips for Collecting Data from Cell Phones

In 2010, electronically stored information (ESI) on cell phones was referred to as “Outlier Data.” Now, as CJ Roberts noted in Riley v California, “ ... it is no exaggeration to say that many of the more than 90% of American adults who own a cell phone keep on their person a digital record of nearly every aspect of their lives—from the mundane to the intimate ... With all they contain and all they may reveal, they hold for many Americans “the privacies of life.”  This session will talk about practical ways to retrieve and search that data.

1:20 p.m. – 2:20 p.m.     Orleans Parish Re-Entry Program

Louisiana’s Orleans Reentry Court Program (ORCP), originated in the Louisiana State Penitentiary at Angola from a desire to equip inmates with vocational, educational, and other skills that could lead to gainful employment and reduce the likelihood of recidivism. Judge Marcus DeLarge took over the program in 2021. During this one-hour program from the Criminal Law Committee, Judge DeLarge will speak on the program and how it has expanded in the past three years. The presentation will focus on who qualifies for the program, what happens after sentencing involving reentry court, and resources and expectations upon release.

3:40 p.m. – 4:40 p.m.     Death of a Plaintiff: Continuing Litigation after a Plaintiff's Passing (Family Law Specialization)

This CLE will explain how a person's legal rights can be represented and pursued after their passing. We aim to help attorneys without a background in successions understand how to appropriately continue litigation in the event that their plaintiff has passed away. We will address Louisiana's succession process in general; the proper process for filing a lawsuit or continuing a lawsuit on behalf of a passed plaintiff; common pitfalls that cause unnecessary frustrations and delays; and other related topics.

4:50 p.m. – 5:50 p.m.      Louisiana Supervisory Writ Practice: Practice Tips and Pitfalls (Appellate Specialization)

Louisiana's supervisory writ procedure allows litigants to seek interlocutory appellate review of nearly all trial court decisions made prior to entry of a final judgment. Two experienced appellate litigators will discuss the different standards and procedures that apply to writs versus appeals and the deadlines and procedures applicable to writ applications in the Courts of Appeal and the Louisiana Supreme Court. We will also discuss traps for the unwary that could derail your effort to obtain review, how best to present your arguments, and how to respond when your opponent has filed a writ application.
