NLRB investigations and Section 10(j) after Starbucks v. McKinney: Is there a meaningful change? CLE
Tue, October 8, 2024
12:00 PM - 1:00 PM CT
This 1-hour CLE will track the NLRB investigative and litigation process with particular attention paid to the General Counsel’s pursuit of NLRA Section 10(j) federal injunction remedies in parallel to administrative remedies. There will be specific review of the Supreme Court’s recent case Starbucks v. McKinney, which overruled the injunction test used by the Third, Fifth, Sixth, Tenth and Eleventh circuits, and united the 10(j) standard across the circuits. The CLE will focus on the General Counsel’s use of Section 10(j) and what, if anything, is likely to change because of the decision.
