The Workers’ Compensation Hearing Rules, Louisiana Administrative Code, Title 40, Part I, Subpart 3 have been amended.  The changes are effective October 20, 2025.  The rule changes were created through the collaborative efforts of workers’ compensation defense and plaintiff attorneys, judiciary, legal drafters, and OWC staff.   The rules are more succinct and include changes including but not limited to the definitions used, court attire and conduct, withdrawal of counsel, procedures for virtual proceedings, memorandum and briefing requirements and deadlines, discovery conferences, scheduling conferences, pre-trial conferences, limitation on expansion of pleadings other than by amendment, fees, and service mechanisms.  There will be a new uniform scheduling order used by all workers’ compensation courts.  There is a new in forma pauperis form, and the 1008 petition has changed to be more specific and informative and to include service instructions on each party. The Hearing Rules can be found at LAWORKS.net under the workers’ compensation section or on the Louisiana Division of Administration’s website, DOA.LA.Gov at www.doa.la.gov/doa/osr/louisiana-administrative-code/.
