The use of AI has become prevalent in almost every facet of society as more and more industries seek to leverage its capabilities. The Healthcare industry is no exception. However, the use of AI in healthcare is only a recent development in Louisiana. Many Louisiana healthcare systems are seeking to employ AI.  For example, Our Lady of the Lake Regional Medical Center in Baton Rouge has begun utilizing IntelliSep, an AI driven sepsis diagnostic tool.  LSU Health and LSU Shreveport are utilizing AI to manage cavernous malformations.

With the increased use of AI in healthcare, the question for the legal community is to what extent AI will impact litigation. History tells us that with increased use of technology, the legal community has to pivot and adjust. For example, in products liability cases where AI software has been integrated into specific products, courts are now tasked with determining whether the integrated software on the device is a service, or a product subject to products liability laws. Further, in motor vehicle accident cases, the advent of self-driving cars are forcing lawyers and the courts to determine responsibility when an autonomous vehicle is involved in an accident.

What effect will the use of AI have on healthcare claims? At this time, the legal implications of AI use in healthcare are developing. However, as the use of AI becomes more prevalent, the legal community will  need to confront and address these issues sooner rather than later.
