Recent Developments in Medical Malpractice Caselaw

Changes to investigations, compliance reviews, and civil monetary penalties are just some of the areas affected by the new HIPAA regulations that went into effect September 23rd. Natalie J. Dekaris (Bradley Murchison Kelly & Shea LLC) discussed Recent Developments in Medical Malpractice Caselaw during a one hour CLE hosted by the New Orleans Bar Association Healthcare Law Committee on September 24th. New prescription developments, the use of experts, summary judgments, damages, and informed consent updates were discussed at length with precedent setting cases used to highlight the changes. Panels, hospitals, standards of care, the PCF, and HIPAA also come into play under these recent developments, and Ms. Dekaris thoroughly covered each area during the continuing legal education seminar. The Healthcare Law Committee will meet on October 29th for their monthly committee meeting.
