MDLs--Recent Trends and Ongoing Challenges

The panel will address issues surrounding the initiation of an MDL, including what and how to argue your position to the JPML, as well as JPML considerations about whether to form an MDL and, if so, where to centralize it.  The panel will then turn to some of the more recent developments that various district courts have used to efficiently manage MDLs, such as requiring an initial census, settlement committees and negotiation classes, and the use of special masters.  Finally, the panel will discuss the benefits and challenges of the bellwether trial and the more recent trend of MDLs not completely resolving litigation and remanding cases to the district courts from which they were transferred.

On Tuesday, June 11, 2019,  the Complex Litigation Committee co-hosted Tips for Making (and Surviving) a Daubert Challenge  with Judge Carl Barbier, United States District Court, Camille Gauthier, Flanagan Partners, LLP, and Stephen Miles, Barasso Usdin Kupperman Freeman & Sarver, LLC.

On Thursday, March 15, 2017, the Complex Litigation Committee co-hosted E-Discovery Simplified & How Your Clients Benefit From Cooperating With Difficult Opposing Counsel CLE with attorney Mark R. Beebe and litigation support specialist Nick Mole, from Adams and Reese LLP.

On Friday, November 3, 2017, the Complex Litigation Committee co-hosted Managing Multi-Jurisdictional Litigation: Opportunities and Challenges in both the State and Federal Systems CLE with speakers Stephen L. Miles and Kyle W. Siegel of Barrasso Usdin Kupperman Freeman & Sarver, L.L.C.

On October 31, 2017, Alexander M. McIntyre, Jr., of Baker, Donelson, Bearman, Caldwell & Berkowitz, PC, presented a Louisiana Competition Law CLE.

On January 31, 2017, there was an introductory meeting for the committee to meet the chair and each other, and to also get an idea of commtitee interest for upcoming programs.
