Product Liability Issues in Maritime Law

The NOBA Products Liability and Maritime & International Law Committees recently teamed up to present a CLE on the crossover of products liability in maritime cases.  The well-attended event featured Billy Swaim of Galloway, Johnson, Tompkins, Burr & Smith, A PLC and Ian Taylor of Lewis, Kullman, Sterbcow & Abramson, LLC, both extremely knowledgeable in maritime and products litigation.  Ian and Billy took the group from the origins of products liability slowly infiltrating general maritime law, first as pure contract claims, then to tort based claims, and ultimately to a full adoption of the 2nd Restatement elements of a products liability claim into maritime law. The group also discussed several of the unsettled areas that still exist in the hybrid field and gave their respective positions on how those areas may resolve in the coming years.
